Welcome to GlucoSpike AI, a product of GlucoSpike LLC, a limited liability company registered in the State of Delaware, United States (“we”, “our”, or “us”). These Terms of Use govern your use of our mobile application and website (the “Services”). By accessing or using GlucoSpike AI, you agree to these Terms.

If you do not agree with any part of these Terms, please do not use our Services.


1. Eligibility

You must be at least 18 years old to use GlucoSpike AI. By using the app, you confirm that you meet this age requirement. We do not knowingly permit use by individuals under 18.


2. Account Registration

To access the Services, you may need to create an account. You agree to:

  • Provide accurate, current information (such as name and email address)
  • Keep your login credentials confidential
  • Notify us immediately at support@glucospike.ai if you suspect unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.


3. Use of the App

GlucoSpike AI is intended for informational and educational purposes only. The app analyzes meal photos to provide food-related insights and a GlucoScore (1–10), where a higher score indicates a better meal choice for blood glucose management. The app also includes a barcode scanner that evaluates packaged food products.

The app does not:

  • Offer medical advice
  • Predict or diagnose any health condition
  • Replace professional guidance from doctors, nutritionists, or healthcare providers

You are solely responsible for how you use the information provided by the app.

Blood-glucose readings you log: The app lets you record your own blood-glucose readings. These are your personal record. We do not verify them, we cannot verify them, and nothing the app shows you alongside them should be used to make decisions about medication or treatment. The app deliberately never tells you that a reading is normal, high, or low — that judgment belongs to you and your healthcare provider, and we have built the app so it does not make it for you.

Communications: By creating an account, you may receive meal reminder notifications (which you can control within the app) and a weekly or bi-weekly educational newsletter (“Beat the Spike”) delivered via email. You may unsubscribe from the newsletter at any time using the unsubscribe link in any email.


4. User Content & AI Processing

You retain ownership of photos, meal logs, and notes you upload.

Patterns: You can optionally tag a meal with how it made you feel (crashed, foggy, energized). This is health data, so we ask for your consent before storing it, through the same step that covers blood-glucose readings. These Patterns are stored under your account so you can look back at what keeps repeating. Patterns are never sent to the AI and are never shared with anyone.

AI Processing: Meal photos and — if you choose to set them — your coach personalization inputs (personal context text and wellness goals) are transmitted to Google’s Gemini API to generate GlucoScores, nutritional estimates, meal insights, and coaching responses. Daily meal summaries and questions you type into the AI coach are also sent to Gemini in real time and are not stored as a chat transcript. The optional personal context field accepts free-text input; an in-app disclosure notice beside that field informs you that anything you enter will be sent to the AI and establishes your explicit consent before the field is used. As of the date of these Terms, Google’s Gemini API does not use API inputs to train its models by default (subject to Google’s enterprise API terms, which may change). No diagnosed conditions, medications, or other clinical data are sent to the AI system unless you voluntarily type them into the optional personal context field.

Blood-Glucose Readings: If you choose to log blood-glucose readings, they are health data, and we ask for your consent before storing any of them. They are never sent to Gemini or any other AI service — not the individual readings, and not any total derived from them. This is why the app never tells you a reading is normal, high, or low: the AI cannot comment on your readings, because it never sees them. See §2.3 and §5.1 of our Privacy Policy for the full detail.

Barcode Scans: Scans are saved to your scan history so you can look back at them. Each entry holds the product name and brand, its nutrition facts, the GlucoScore and verdict, and the barcode and time. Deleting your account removes them.

You agree not to upload:

  • Inappropriate, offensive, or unlawful content
  • Photos containing personally identifiable information of others without their consent

5. Prohibited Conduct

You agree not to:

  • Reverse engineer, copy, or resell any part of the app
  • Use the app for commercial purposes without written consent
  • Violate applicable laws or regulations while using our Services
  • Attempt to circumvent subscription access controls

6. Intellectual Property

All content, branding, and technology used in GlucoSpike AI (except user-uploaded content) are our property or licensed to us. You may not reproduce or use them without our written permission.


7. AI Transparency & Limitations

GlucoSpike AI uses Google Gemini to generate GlucoScores and nutritional analysis. You acknowledge that:

  • GlucoScores are AI-generated wellness estimates, not clinical measurements
  • Results may vary based on actual portion size, preparation method, and individual physiology
  • The AI has no knowledge of your personal medical history, diagnoses, or medications
  • The app is not a substitute for a continuous glucose monitor (CGM), a registered dietitian, or your healthcare provider

The glucose response the app draws is a model, not a measurement. Where the app shows you a curve or a predicted response, that is an estimate of how a meal may affect blood sugar. It is not a record of what your blood sugar actually did. Where one of your own readings is displayed alongside it, the reading is yours and the line is our estimate — they are two different kinds of thing, and the app is designed to keep that distinction visible rather than blur it.

Learning from your readings does not make the estimates clinical. If you log readings, the app may compare what it predicted against what you measured and adjust its estimates for you over time. That makes the estimates better tuned to you. It does not make them clinical measurements, diagnostic, or a substitute for testing.

You are interacting with an AI system each time you receive a GlucoScore or product scan result.


8. Subscriptions, Payments, and Billing

Required Subscription: GlucoSpike AI requires a paid subscription to access its Services.

Free Trial: A 7-day free trial is available. At the end of this trial, your subscription will automatically convert to a paid plan unless canceled before the trial expires.

Billing: Subscriptions are billed through third-party platforms (Apple App Store, Google Play) and managed via RevenueCat. By purchasing a subscription, you agree to the payment terms of the respective platform.

Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless canceled in advance. Charges are made according to the platform’s policies.

Cancellations: You may cancel your subscription at any time via your App Store or Google Play account settings. Deleting the app does not cancel your subscription.

Refunds: All refunds are handled by Apple or Google in accordance with their respective policies. We cannot issue refunds directly. See our Refund Policy for full details on how to request a refund and what to expect.

Price Changes: We may adjust subscription pricing from time to time. You will be notified in advance, and continued use after changes constitutes acceptance of the revised pricing.


9. Termination

We reserve the right to terminate or restrict your access if you violate these Terms, misuse the app, or engage in harmful behavior. You may also delete your account at any time via Settings → Account → Delete Account within the app.


10. Disclaimer of Warranties

GlucoSpike AI is provided “as-is” without warranties of any kind. We do not guarantee that the app will be error-free, always available, or perfectly accurate. Use the app at your own discretion.


11. Limitation of Liability

To the maximum extent permitted by law:

  • GlucoSpike AI and its team are not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of health outcomes, lost profits, data loss, or business interruptions.
  • The app provides informational and educational insights only. We do not guarantee accuracy, completeness, or health outcomes from using the Services.
  • Health Disclaimer: The app does not provide medical advice. Always consult a qualified healthcare provider before making dietary, lifestyle, or medical decisions.
  • Financial Disclaimer: Subscription fees are paid for access to premium features. We do not guarantee specific results such as weight loss, reduced blood sugar, or improved health markers.
  • Jurisdictional Limits: Some regions do not allow certain liabilities to be excluded. Where an exclusion is not permitted, our liability is limited to the maximum extent applicable law allows.
  • Liability Cap: Where a cap is permitted, our total liability for any claim relating to the Services will not exceed the greater of (a) what you paid us in the 12 months before the claim, or (b) USD $100.
  • What we do not limit: Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless GlucoSpike AI, its affiliates, employees, and partners from any claims, damages, or expenses arising from your misuse of the app or violation of these Terms.


13. Privacy

Please review our Privacy Policy to understand how your data is collected and used.


14. Changes to These Terms

We may update these Terms from time to time. Continued use of the app after changes means you accept the revised Terms. We will notify users of material changes where required.


15. Governing Law

These Terms shall be governed by and construed under the laws of the State of Delaware, United States of America, without regard to its conflict of law principles. The Services are provided by GlucoSpike LLC, a Delaware limited liability company.
